What "Foundation" Means for Drone-Captured Evidence
Attorneys often ask whether drone imagery is admissible. That decision belongs to the court—but the foundation behind the evidence can shape how it is evaluated: who captured it, how it was collected, and whether the record has remained intact. Here is what that means in practice.

The question I can’t answer for you
Attorneys often begin with the same question: Is drone-captured evidence admissible?
The honest answer is that admissibility is for the court and judge to determine. It depends on the facts of the case, applicable rules of evidence, and the foundation established for the material. No responsible service provider should promise otherwise.
What can be addressed is the documentation behind the imagery: a capture process designed to be clear, traceable, and capable of withstanding scrutiny. That includes work performed by someone who has had to explain photographic documentation, collection methods, and evidentiary foundation under oath.
The three questions behind foundation
At its core, foundation generally comes down to three practical questions:
Who captured the evidence?
What method was used to capture and document it?
Is the record intact—meaning the material offered is the material collected, with its handling and preservation documented?
The details may vary by matter, but those questions are central to evaluating any captured evidence.
Notice what is not the focus: the drone itself. The aircraft is a tool. What matters is the competence and credibility of the person using it, the method used to collect the imagery, and the integrity of the resulting record.
Why the record matters more than the camera
In a contested matter, the discussion is rarely about image resolution alone. The questions tend to focus on method and preservation:
How was the scene documented?
What was captured, and why?
Were time stamps, file records, and original materials preserved?
Could the images, video, maps, or models have changed between collection and presentation?
Can the person who captured the material explain the decisions made in the field?
Those are the issues that determine whether documentation is understandable, defensible, and useful when examined by someone who was not present at the scene.
The difference is not simply between an investigator who owns a drone and a pilot who can produce attractive aerial images. It is the difference between capturing a scene for visual appeal and documenting it with the discipline required for later review, testimony, or litigation.
That discipline must begin with the first frame. It cannot be added later.
What a defensible capture record contains
A defensible aerial documentation workflow is built around clarity, preservation, and repeatability. In practice, that means:
A documented capture method appropriate to the scene and purpose.
Preserved original imagery and data files.
Retained timestamps and relevant metadata.
Clear organization of photographs, video, maps, measurements, and derived deliverables.
A record of how the material was collected and handled.
Documentation that remains understandable to the attorney, expert, insurer, investigator, or court reviewing it later.
The same standard should apply whether a matter ultimately becomes contested or not. At the time of collection, no one knows which image, angle, measurement, or condition may become important later.
The data must also remain objective. It should show what was present—not what a retained party hopes it will show. If the documentation does not support a particular theory, that can still be valuable information to have early rather than discovering it after positions have hardened or trial preparation is underway.

Why the call comes at a bad hour
Scenes have a shelf life measured in hours, not weeks.
Gouge marks can be plowed over. Debris can be removed. Temporary traffic-control conditions can disappear. Vegetation can obscure a sight line. Weather, lighting, traffic, construction activity, and repair work can materially change a location before anyone has the opportunity to document it.
The difference between a documented scene and a described scene is often simply who arrived first.
For an active matter, a phone call is usually more effective than an email. It allows us to quickly determine whether aerial documentation, terrestrial photography, 3D capture, mapping, thermal imaging, or another approach is appropriate for the question at hand. If aerial capture is not the right tool, you should know that during the initial conversation—not after time has been lost.
